Default Question about fighting a ticket via mail...

I have court next week to fight a stop sign ticket. I called to try to reschedule it so I could still get to work that day, but they told me I would have to petition the judge and that it would be unlikely to be rescheduled. They did offer me the option to send in notarized testimony via fax.

My question is thus: If I fax in my testimony/pics, and the officer doesn't show, will it still be all thrown out; or, do I have to be physically present for that to fly?

Here in CA, the first reschedule is automatically allowed via an automated phone system and only additional extensions require the judge's approval.

If you are mandated to appear or fight via mail, it should be treated the same. The charges should be dismissed, as long as your testimony is available, whether by you in person or by you via notarized/faxed statements and the officer doesn't respond. Good luck.

I fought a ticket by mail, it ended up getting dismissed I also delayed my appearance (mail-in) date by calling the police station and requesting an extension. As said, the first extension is very easy to get, they really can't deny you. The longer you can delay it and the more detail you can add to your written statement, the better the odds that the citing occifer won't remember who you are.

Thanks guys, I think I'm just going to end up going in. The date is tomorrow. I called last week to try to get an extension, but the clerk told me that they give extensions only if you petition the judge. So that's out. The ticket was back in October, so I'm hoping that's enough time.
