Default got the best christmas present today

in february this year i got caught doing 80+ in a 25. the cop wrote me an excessive speeding and reckless driving. i was lucky not to spend the day in jail.

my lawyer managed to get a few continuances, the last one because the state was not ready to proceed and we were. we went back to court today and the cop was there and the state was ready to proceed.

our state only recently passed a law that states that the defendant is now allowed to inspect the cops' speedo calibration certificate (i was paced), where prior the cop did not have to prove the accuracy of his speed reading device - go figure that. off course we asked the state to provide this evidence, and up until today they have not produced it.

so today my lawyer said the state have not provided all the evidence we had asked for, that we were now more than 6 months after the date of my "arrest" - infringing on my right to a speedy trail -, and that we wanted the case dropped. oh... and my lawyer said to the judge, "your honor, it is christmas, how about some christmas spirit".

the judge dismissed with prejudges.

that was a nail biter let me tell you.

Out of curiosity, how much did the legal defense cost you? Whatever it was, it sounds like it was worth it.

Wow, Congrats on thats one!

I recently got pulled over doing 61 in a 45 in my truck. I had just got back from a 300 mile trip and took a different route than I usually did and was not aware the speed reduced from 55 to 45. Cop paced me and pulled me over. I explained to him that I had just gotten back from a long trip and was very tired and trying to get home..he looked at my tripometer ran my license through and told me He was letting me go with just a verbal warning as a christmas present! Best gift I have received yet!

^legal advice cost me nothing. the lawyer is a friend and did not want to charge me. i did pay his airline ticket for a recent trip to LA though. however, legal fees would have been in the thousands, probably $5,000 had it been another lawyer. not to mention the fine and added insurance - i don't want to even think about that.
