I am totally happy right now...
Just got home and picked up the mail to find out that I won my speeding ticket via trial by declaration. I have won in court several times and even an appeal through appellate court but this is my first win through the trial by declaration process.
Basically, on 8/24/07, I got a ticket for doing 41 in a 25 residential zone, but the speed went from 25 to 40 in across the stop sign where I was stopped. The officer was parked on the side of the road just before the stop sign where the speed change takes place and he had lights off at night time. By the time I realized it was a CHP, I couldn't tell whether he lived there or was patrolling but he turned on the lights, waited for me to pass and pulled me over. Total speed trap and I argued it on that basis in a general sense, focusing on the wording of the statute (CVC 22350). I alread paid $247 for the fine and they will be mailing it back to me in a couple of weeks.
Nothing better than winning against a BS ticket...couldn't be happier...
