Default 89 in a 45 on ACH (CA Hwy 2)

Well first off i don't want to be placed in the same category as the other tread (92 in a 45) because i was not pulled over on city streets, i read the criticism he got and i agree it's pretty stupid to get your license revoked and go out speeding after that. I received a speeding violation on ACH (CA Hwy 2) and any southern california rider that rides canyons knows this road and exceeds this speed limit. For non california riders this is a popular ride where speeds average around 70 in turns and can push 120 in some straights (not that it's always ridden that fast) and there is light traffic because the road is closed 3/4 of the way up so it basically doesn't go anywhere and there are lots of "old men" on that road that can put us "young guys" to shame.... to all the old guys out there (40+) that ride fast

Anyways i was just wondering if anyone had any advise or success stories for fighting speeding tickets such as this one (89 in a 45) also i have a class B license and i am worried this will be affected anybody know?

i was thinking about doing a trial by declaration, how many other people have had success or not with this method?

do a trial by declaration and hope the cop doesn't write in

was it stout that pulled out over, the guy on the bike?

no it wasn't, i have heard about stout though. It was morrin, he was in a CHP truck with a camper shell

Just pay the ticket. Take responsability for what you did. You will most likely have to do that ayways, they are not very lenient at all twards riders up there. Be glad it wasn't Stout, he very well could have had them come pick up your bike, giver you a reckless ticket and been on his way...

In the class B thing, it will have no effect on your status. The only time it does is when you are ticketed opperating a vehicle in that class.

I don't know what your source is but i'm pretty sure that your wrong. I don't know if this ticket will be an issue or not right now but i do know if it isn't cleared off my record and i get another one for 15 MPH or over within the next 3 years then my license gets suspended for 60 days and that could mean my job. It's not the money that's going to hurt me it's the point on my record and class B drivers can't take traffic school so i'm going to do everything i can to fight it

And no i didn't get stuck with reckless driving, i passed the attitude test so the cop gave me a break and just wrote me for speeding. and i am thankful for that

I would hire an attorney. For regular speeding tickets they are only a couple hundred bucks (for a good one) which is what you will pay anyway... if they can't get it dropped, they will (hopefully) at the very least get it knocked down considerably.

I've fought a few tickets myself but the big dings (esp with State Po using laser), I've used a lawyer and walked away scott-free.

what was the method of obtaining your speed? did he use a radar? If so there is a set of laws which are CVC 40801 through 40807 to keep everyone in check when using radar. if the cop uses radar the prosecution must justify the speed limit with a traffic survey, if they dont its a speed trap and if it is a speed trap you walk. before i hear people say i am wrong yes i very well might be as i live in tx and dont know cali law but i heard about this so you should at least look into it. www.helpigotaticket.com might be useful just follow the steps.
