Need advice was hit by a car and pissed
Ok guys heres my story ( now im not a writer so I suck at this but ill try)
I was heading home leaving a buddies place. it was at about 12:30 at night. I was going straight and I seen this car coming and they had there blinker on. So I slowed down some, probably going around 25. I was pretty sure the car seen me but I was wrong, as I was getting in the middle of the intersection she turned, it was to late for me to do anything and she t-boned me pretty much. It happened to be a 17 year old girl with 2 younger friends in the car, I was pissed I got up, pulled my phone out to call the cops and it was smashed in my pocket. So I was like you better call the cops and the cops showed up, we gave him the stories she admitted it was her fault, the bad part is the cop asked for her insurance and she had no clue what he was talking about so I was like f***. I got the police report and her insurance info was not on it, so for the next 3 weeks I dealt with her parents they where going to just buy my bike and pay all my medical and my phone and few other things. Well they just BS me for 3 weeks. I was so pissed I contacted the police twice finally getting there insurance info, I say F*** them and turn it in, everything gets started now. Here’s where I need advice to what im really owed. I had an estimate done it came to 4500 with out paint (oh yea I have a 01 R6 45000+ miles with extras and 05 tranny upgrade) the paint I estimate to be no less then 1500 to match what was on it. Well what I was told was the estimate I had done at a Yamaha dealer ship was worthless. The insurance company “Farmers” told me I could take it to this body shop (where they have there estimates done at). Or will send an adjuster out to my place well im at work.. ( im thinking do you take your Ford to Chevy dealer to get fixed?) then I was told I was to pay all my medical bills up and when im all done with treatment, they would pay it back. I was like fine then your paying me interest on that money your borrowing form me and he just laughed at me, then I was like fine get me a bike rental and he laughed again he’s like there’s no fun in this. So I was getting more pissed off and was like your also paying for my insurance I’ve been paying sense the date of the crash because my bike is not ride able and he was like no cant do that the claim was filed 2 days ago and pretty much told me it was all my fault for not turning in the claim in tell then. I stressed to him that his customer refused to give me the information, but yea still told me it was my fault that it didn’t get turned in earlier. The girl was also giving a ticket for no proof of insurance and maybe one for not yielding but not for sure. So here is what id like to know, I missed 3 days of work, I spent 5 days not being able to do anything and the next two weeks at work sucked form being sore, and my backs still bugging me. his customers stressed me out like crazy for those 3 weeks im still stressed out about things, what is fair? Is there such a thing for pain and suffering? Why cant I get a rental bike or they pay everyday for not being able to use it? Shouldn’t they pay my insurance well I cant drive it? I was the victim why are they treating me like sh** if they don’t offer at least 4850.00 for my bike and pay med, phone and few other lil things. I guess ill have get a lawyer whats your guys thoughts? Thanks

Talk to a lawyer or you will get only the bare minimum and a lot of BS from the insurance company.

you cant repaint factory bodywork... you CAN repaint your tank but in EVERY mc crash I have seen if its damaged it gets replaced... period. internal damage to a tank can cause major headaches down the road.
replace all damamged pieces on the bike, compensate you for time off work. Keep the estimate at a yammi dealership, there is noway an adjuster or bodyshop can do it right... consult an atty.

A lawyer is the only way to go in this case. Right now you are just another petty person that takes up a bit of their time. Get a lawyer and they HAVE to deal with it the correct way or they will be looking at forking out even more money. At least consult a lawyer, that is usually free.
