"dont be a squid, wear your lid" saved my life
so long story short, riding in curb lane and cars pull in front of me. i locked up the rear, went indo, slid under the car and the bike hit the side of the car. after hitting the car, the bike slammed into a light pole. shitty thing is the fucking cop tried to cite me for unassured clear distance, without even taking to me about it. i talked to the cop and no one was cited. i called my insurance this morning and they talked to the guy. from what i was told, be basically said he pulled out in front of me, but i was "speeding." why is it when someone hears a sport bike at 6k rpm they think the biker must be speeding. any way, my insurance guy told me that his insurance will pay for it, but they will try to say that i "speeding" so they will only give me a certain % of what the bike is worth. bull shit i say. i calculated my speed to be 35mph at the time i started to slow down. used basic physics and a place that uses the length of the skid mark to determine speed. my insurance guy said if they pull that shit, he has an "expert" that will calculate the speed for me.

ya i am not too bad. my face must have hit the gas tank, due to the large dent in the middle of it and i face shield got ripped off by the pavement. i have some rash, my neck is killing me and my knee is bothering me. but if i wasnt wearing anything, i would have been fucked up. would anyone know why their insurance company could only give me a % of what the bike is worth due to me "speeding?" the reason i know i was not go over, or by much, is that i car pulled in front of me in the intersection and i had to slow down. i was speeding back up and people heard the exhaust and assumed i was speeding. the intersection to where the car pulled out was about 100-200 ft in distance at the most. fucking insurance companies. so i guess i will not be riding anymore this season. i hope to pick something up in the winter with the good prices. i'll stay in the yamaha fam and i am thinking about an 04 r1. thanks guys

If you weren't cited for speeding, they can't take anything off of your settlement for it.
Also, if you're injured, you should be compensated for that, as well. I'd make sure to stay on top of your insurance company to make sure they wring the other guy for everything he's got.

Honestly you might want to get a lawyer. You were hurt and you should be compensated for that to the fullest. I got into an accident a while ago (friend rear ended me) and i didnt try and get compensated for injury, because at the time i didnt really think i had anything wrong with me. About a week later i started getting really bad back pains, which ended up being associated from the accident and now my back is severely fucked. And that was in a car, so im sure your back isnt fairing too well either. I would get it checked out and make sure you get some dough out of this at least. And Cephas is right, if you werent cited for speeding the insurance company cant knock you for it, its not their decision to make whether or not you were or were not, thats a job for the police.
